A German couple is suing cruise line Tui after being booted off the ship Mein Schiff 5 for having loud sex.
The twosome, identified as Renate F. and Volker by Germany’s Reise Reporter, was on the first of a fourteen-day cruise in the Caribbean. Renate said that she and her husband accidentally left their balcony door open while making ‘passionate’ love and admitted to being a ‘bit loud’. She emphasized that the sex was consensual.
This was followed by a noisy argument, however, the pair insist that there was neither violence nor damage to the cabin.
The ship’s hotel manager and a member of the security personnel then visited the couple and told them they had to leave the ship.
According to Reise Reporter, Mrs F. is suing the cruise company for damages, compensation for pain, legal costs and reimbursement of travel expenses, which included the cost of a ‘crazy taxi ride’ in Barbados, three nights accommodation on the island and the unscheduled return flight to Paris, a night in France and then a train trip back to Frankfurt.
In addition, the couple paid around 5,800 euros (about R95,000) for the cruise and only experienced a few hours of the trip.
According to Tui’s conditions of carriage on cruises ‘if in the opinion of the carrier’s representative, the passengers’ behaviour is disruptive, threatening or abusive or is causing or is likely to cause danger or distress to others, the carrier may terminate that passenger’s travel arrangements without any liability on the carrier’s part and the passenger will not be entitled to any refund for unused or missed services or costs incurred resulting from the termination of the travel arrangements. Passengers will be responsible for their own return home and for any other members of their party who cannot or will not travel without the passenger.’
It also states that if a passenger is “likely to endanger his or her health or safety or endanger the health or safety of others on board”, he or she can be ‘disembarked at any port’.
According to the German newspaper, a spokeswoman for Tui Cruises said that ‘due to a security-related incident … we asked the guests to leave the ship’.
‘There has already been correspondence with Mrs F. in which we have set our view of things. Please understand that we do not want to comment on the privacy of our guests in detail.’
